Nhưng làm thế nào để được Bộ Di Trú Úc chấp thuận cho bạn ở lại? Visa lao động 482 cho phép bạn tiếp tục làm việc tại Úc và là con đường tắt cho bạn để có được thường trú vĩnh viễn tại Úc.
Visa 482 là Visa tạm trú dành cho những lao động có tay nghề sang làm việc cho doanh nghiệp tại nước Úc trong thời gian từ 2– 4 năm. Muốn làm Visa 482, bạn phải được doanh nghiệp đã được chính phủ Úc cấp phép để bảo lãnh. Sau 3 năm được cấp Visa 482, nếu ngành nghề nằm trong danh sách MLTSSL, người lao động có thể xin Visa thường trú tại Úc theo diện visa thường trú 186.
Điều kiện để xin visa:
- Được doanh nghiệp bảo lãnh và chỉ định sang lao động tại Úc.
- Ngành nghề phải nằm trong danh sách STSOL hoặc MLTSSL.
- Chứng chỉ tiếng Anh IELTS 6.0 (overall)
- Đã tốt nghiệp hệ trung cấp, cao đẳng trở lên hoặc có kinh nghiệm 02 – 05 năm trong nghề (tùy ngành).
- Đáp ứng yêu cầu về thẩm định tay nghề (tùy ngành nghề).
- Đáp ứng các yêu cầu về đăng ký và bằng cấp, chứng chỉ hành nghề cần thiết cho công việc được chỉ định. (tùy ngành nghề)
Theo quy định, những người thân có thể xin Visa 482 cùng với đương đơn là: vợ, chồng hoặc bạn đời chưa chính thức; con của vợ chồng hoặc con riêng của vợ, của chồng; người thân phụ thuộc khác. Người thân của đương đơn được phép làm việc và học tập không hạn chế tại Úc.
Yêu cầu để trở thành doanh nghiệp bảo lãnh lao động:
- Đang hoạt động tích cực và hợp pháp tại Úc.
- Đáp ứng yêu cầu về đào tạo nhân viên bản xứ Úc của họ (hoặc nếu doanh nghiệp mới thành lập và hoạt động dưới 12 tháng, doanh nghiệp phải có một kế hoạch để đáp ứng những tiêu chuẩn đó). Hoặc:
- Đang hoạt động tích cực và hợp pháp tại nước ngoài (ngoài Úc), và đề cử đương đơn đến Úc để điều hành hoạt động kinh doanh, hoặc thực hiện nhiệm vụ của hợp đồng.
Yêu cầu của vị trí công việc đề cử:
- Công việc được đề cử phải là một vị trí công việc xác thực trong doanh nghiệp.
- Công việc đề cử phải trong Danh sách Ngành Nghề được bảo lãnh (STSOL & MLTSSL).
- Mức lương tối thiểu dành cho loại visa này là $53,900/ năm.
- Có các điều khoản và điều kiện làm việc (bao gồm tiền lương) tương đương với điều khoản và điều kiện so với người bản xứ làm cùng vị trí công việc, không được kém hơn.
Điều kiện xin visa dành cho đương đơn:
- Đáp ứng yêu cầu về ký năng tiếng Anh. (IELST 6.0 overall)
- Có bằng cấp, trình độ hoặc kinh nghiệm làm việc phù hợp với những yêu cầu của vị trí đề cử được định nghĩa trong ANZSCO code của mỗi ngành.
- Đáp ứng bất kỳ yêu cầu về giấy phép, đăng ký hoặc thành viên chuyên nghiệp nếu bắt buộc.
- Có bảo hiểm y tế trong suốt thời gian làm việc tại Úc.
- Tùy trường hợp mà đương đơn có thể phải trải qua việc thẩm định tay nghề để xem xét trình độ và kỹ năng đối với ngành nghề được đề cử.
Quy trình xin Visa Úc 482:
Visa 482 là một trong những loại visa được xin nhiều nhất bởi nhu cầu lao động sang Úc khá cao, việc xin visa này đòi hỏi phải được duyệt qua quy trình như sau:
- Bước 1: Chủ sử dụng lao động nộp đơn xin đăng ký làm người bảo trợ hợp pháp cho người lao động.
- Bước 2: Chủ sử dụng lao động nộp đơn đề cử một vị trí công việc, công việc này phải nằm trong hệ thống ngành nghề STSOL hoặc MLTSSL của Úc.
- Bước 3: Sau khi đơn xin đề cử được chấp nhận, chủ sử dụng lao động nộp đơn xin Visa 482 cho nhân viên.
Đương đơn có thể nộp những hồ sơ kể trên theo thứ tự từng giai đoạn, hoặc cũng có thể nộp một lần cả 3 hồ sơ. Chủ yếu là đương đơn phải đáp ứng đầy đủ các yêu cầu nêu trên cho từng diện hồ sơ liên quan, cùng với việc kiểm tra sức khỏe và pháp lý.
Ngành nghề theo Visa lao động 482 rất đa dạng, người lao động có thể chọn một trong các nghề như: đầu bếp, thợ mộc, thợ hàn, thợ sửa chữa ô tô, thợ điện, làm bánh, nhà hàng khách sạn, làm tóc…Một khi Bộ Di Trú phê duyệt cả ba bước trên, đương đơn sẽ được cấp visa tạm trú. Visa tạm trú có thể sẽ được từ 2 đến 4 năm. Sau 3 năm sở hữu visa 482, đương đơn có thể nộp đơn xin visa thường trú 186.
